Abstract

The distribution of inheritance in Islamic law mandates certainty regarding the heir's death, including cases where the heir is declared missing or mafqud. mafqud refers to an individual who has left their residence without any known whereabouts, whether alive or dead. Under the Compilation of Islamic Law (KHI), the property of a mafqud cannot be distributed until there is concrete evidence of their death. This study analyzes the provisions of KHI on mafqud inheritance, examines inheritance practices in Sirantau Subdistrict, Datuk Bandar District, Tanjungbalai City, and evaluates these practices based on KHI. A normative method was used, focusing on literature analysis, including perspectives from the Shafi'i School regarding mafqud inheritance.  The findings indicate that inheritance distribution in Islam is permissible only after authentic evidence of the heir's death, with a mandatory waiting period exceeding four years. However, in Sirantau Subdistrict, five cases were identified where mafqud inheritance was distributed based solely on the duration of the heir's absence, without confirmation of death. This practice conflicts with the Shafi'i School's requirement for definitive evidence. The study highlights the need to improve public awareness of Islamic inheritance laws to ensure compliance, prevent deviations, and maintain justice in implementation.
